General Conditions of Sale (GCS)

ARTICLE 1 – Scope of application

These General Terms and Conditions of Sale (hereinafter "GTC") apply, without restriction or reservation, to all sales concluded by the company CASSY , SAS with capital of €4,000, registered with the Bordeaux Trade and Companies Register under number 888 347 820 00043 , whose registered office is located at 45 rue d'Armagnac, 33800 Bordeaux , (hereinafter "the Seller") to consumers and non-professional buyers (hereinafter "the Customer"), wishing to acquire the products offered for sale on the site www.cassyshoes.com (hereinafter "the Site").

The Customer declares that they have read and accepted these General Terms and Conditions before placing their order. Validation of the order constitutes unreserved acceptance of these General Terms and Conditions.

ARTICLE 2 – Products offered

The products offered for sale are those which appear on the Site on the day of consultation by the Customer, within the limits of available stocks.

Each product is presented on the Site with a description including its essential characteristics. CASSY strives to represent product characteristics as faithfully as possible to reality.

Before placing an order, we invite you to carefully study the description and characteristics of the product.

ARTICLE 3 – Prices

The prices displayed on the Site are indicated in euros including all taxes, including the VAT applicable on the day of the order.

The Seller reserves the right to modify its prices at any time. Products will be invoiced based on the prices in effect at the time the order is placed.

Delivery costs are indicated during the ordering process and are added to the price of the products ordered.

This price is payable in full and in a single payment.

Any order shipped outside of France may incur taxes and customs duties, to be paid upon arrival of the package in the destination country.

Any customs fees and taxes associated with delivery are the responsibility of the customer, who assumes full liability for them. CASSY is not required to verify the amount or inform its customers of them.

ARTICLE 4 – Order

4.1. Placing an order

Orders are placed exclusively online via the website www.cassyshoes.com and are managed directly by CASSY.

To order, the Customer selects the product(s) of their choice, specifies the desired quantity, the variant and clicks on “Add to cart”.

The Customer can view their shopping cart at any time by clicking on the dedicated icon. Once the cart has been checked, simply click on "Finalize my order" to continue.

The Customer must then enter their email address in order to create an account, log in to their existing account or continue as a guest.

  • When logging in, the Customer enters their password to access their account.

  • In the absence of an account, the Customer follows the steps proposed to provide the information necessary for the order, and can choose whether or not to receive commercial communications from CASSY.

The Customer is asked to provide a precise delivery address, as well as their personal contact details (surname, first name, telephone number).

CASSY declines all responsibility in the event of an error in the information provided by the Client (in particular address or identity errors).

The Customer must also choose their delivery method from those offered.

Before final validation, the Customer has the possibility to review the details of his order, to correct any errors or to modify his basket.

Validation of the order implies full and complete acceptance of these T&Cs.

At the end of the order, the Customer receives a confirmation email summarizing all the products purchased, the delivery conditions and the total amount paid.

CASSY retains ownership of the items ordered until full payment of the order.

4.2. Modification of the order after confirmation

We will endeavour, where possible, to accommodate any request, but we reserve the right to refuse the change if it is not feasible or results in additional costs.

4.3. Validation and cancellation of order

CASSY reserves the right to refuse or cancel any order:

  • In the event of an existing dispute with the Client,

  • In the event of a payment incident on a previous order,

  • Or if the order is abnormal (particularly in the case of exceptionally high quantities)

Validation of an order is subject to stock availability.
In the event of unavailability of one or more products after confirmation, CASSY will inform the Customer as soon as possible and will offer either a refund within a maximum of 14 days, or an exchange according to the Customer's preference.

ARTICLE 5 – Payment

5.1. Available payment methods

For orders shipped to mainland France, the Customer can pay for their purchases using the following methods:

  • Bank card: Visa, MasterCard, Carte Bleue and American Express,

  • Payment via PayPal or Apple Pay,

  • Use of a CASSY Gift Card,

  • Payment in installments thanks to our partner ALMA.

For orders shipped outside mainland France, payment is possible:

  • By bank card: Visa, MasterCard, Carte Bleue, American Express,

  • Via PayPal.

5.2. Payment validation

Payment is deemed validated once all necessary checks have been carried out, particularly in the event of increased control for bank card payments (see anti-fraud).

Upon validation of payment by CASSY, the sales contract is definitively formed, subject to the legal right of withdrawal.

After payment acceptance and order confirmation, a summary email is sent to the Customer. This message specifies the items purchased and an estimated delivery date.

The order is considered final only upon sending this confirmation email. Ownership of the products is transferred to the Customer once full payment has been made.

In the event of total or partial non-payment, CASSY reserves the right to recover the products delivered and to suspend any current order.

ARTICLE 6 – Delivery

6.1. Delivery areas

CASSY offers shipping of its products to:

  • Metropolitan France, Belgium, Luxembourg, Spain, Germany, Austria and all other European countries.

  • Certain countries outside the European Union, including: South Africa, Canada, the United States, Australia and the United Kingdom.

The Customer has the choice between several shipping options (Metropolitan France):

  • Standard home delivery with GLS (estimated delivery time 24-48 hours),

  • Delivery to a relay point with Colissimo (no obligation to purchase from the merchant) – (estimated time of 48-72 hours)

  • Express home delivery in France with GLS (24-hour delivery time).

6.2. Enhanced security during shipments

Orders are sent to the address provided by the Customer at the time of purchase. It is the Customer's responsibility to provide all necessary information to ensure smooth delivery (exact address, floor, entry code, name on the mailbox, authorized recipient, etc.).

In the event of incomplete or incorrect information, CASSY cannot be held responsible for any failure or delay in delivery.

In the event of a special request made by the customer directly to the carrier (such as: leaving the package in front of a door, in a mailbox, at a neighbor's or any other unsecured location), CASSY declines all responsibility in the event of loss, theft or damage to the package after its delivery.
Delivery will then be considered complete as soon as the carrier has confirmed the drop-off or delivery of the package according to the customer's instructions.

6.3. Processing and shipping times

Outside of sales periods, any order validated before 7:30 a.m. from Monday to Friday (excluding public holidays) is prepared the same day, subject to payment validation.

The average delivery time for an order shipped to mainland France is 48 working hours from the order date.

6.4. Delay in delivery

If the order has not been delivered within 7 working days following the estimated delivery date (excluding cases of force majeure or difficulties attributable to the carrier), the Customer may request cancellation of their order.

Full reimbursement of the amounts paid will then be made.

6.5. Order tracking

CASSY offers a tracking service allowing the Customer to know the progress of their order.

Receipt is deemed to have taken place as soon as the carrier confirms delivery or the relay point validates the collection of the package.

In these cases, no refund will be possible.

In the event of a dispute, CASSY reserves the right to verify the facts before any reimbursement decision and by requesting a sworn statement.

Delivery of packages requires the presentation of an identity document and the signature of the Customer, proof of actual receipt.

6.6. Verification of products upon receipt

Upon receipt of the package, the Customer is invited to check the condition and conformity of the products delivered.

Any anomaly (missing item, damaged product, open or damaged package, order error) must be reported to CASSY within a maximum of 48 hours after receipt, by email or via the contact form. After this period, no claims will be accepted.

ARTICLE 7 – Right of withdrawal

In accordance with Articles L.221-18 et seq. of the Consumer Code, the Customer has a period of 14 calendar days from receipt of the product to exercise his right of withdrawal from CASSY, without having to provide reasons or pay penalties.

To exercise this right, the Customer must notify their decision to withdraw before the expiry of the aforementioned period, by sending:

  • Either an email to the address: sav@cassyshoes.com ;

  • Either a postal letter addressed to:
    CASSY - 45 rue d'Armagnac, 33800 Bordeaux.

To exercise this right, the Customer can also notify their decision by making their request on the return portal: https://cassyshoes.com/apps/parcelpanel-returns/

The Customer must comply with the return policy and return the product(s) concerned, in their original condition and complete (packaging, accessories, instructions, etc.), at the Customer's expense, to the following address: ASAR / CASSY
4 rue du champ de montigny, 49080 Bouchemaine, France.

CASSY will refund all sums paid, including standard delivery costs (except return costs), no later than 14 days from receipt of the product.

The customer is required to keep the proof of deposit provided by the carrier when returning their package. In the event of loss of the return, no refund will be issued by CASSY.

ARTICLE 8 – Legal guarantees

The products sold on the Site benefit from:

  • From the legal guarantee of conformity (articles L.217-3 et seq. of the Consumer Code),

  • Guarantee against hidden defects (articles 1641 et seq. of the Civil Code).

To activate the guarantee, the Customer must send their request to: sav@cassyshoes.com .

ARTICLE 9 – Liability

The Seller cannot be held responsible for any damage resulting from improper use of the purchased product.

The Seller's liability is in any event limited to the amount of the order.

ARTICLE 10 – Personal data

The Customer is informed that the collection of his personal data is necessary for the sale of products on the Site. This data is processed in accordance with our Privacy Policy available at https://cassyshoes.com/pages/politique-de-confidentialite

ARTICLE 11 – Force majeure

In the event of force majeure, CASSY shall not be held liable for the total or partial failure to perform its obligations. Force majeure includes, but is not limited to, strikes, bad weather, natural disasters, pandemics, acts of war, telecommunications network failures, or any other circumstances beyond the reasonable control of the Seller.

ARTICLE 12 – Disputes – Applicable law

These T&Cs are subject to French law.

In the event of a dispute, the Customer is invited to contact customer service as a priority to attempt an amicable resolution: sav@cassyshoes.com .

In the absence of an amicable agreement, the Customer may contact a consumer mediator free of charge in accordance with Articles L.612-1 et seq. of the Consumer Code, or bring the dispute before the competent French courts.

In accordance with Article 14 of Regulation (EU) No 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating independent out-of-court settlement of online disputes between consumers and traders in the European Union. This platform is accessible at the following link: https://webgate.ec.europa.eu/odr/ .

The selected mediator is: CM2C Consumer Mediation Center of Justice Conciliators. In the event of a dispute, you can report it directly on the platform: https://www.cm2c.net/declarer-un-litige.php

As part of the fight against fraud, CASSY reserves the right to check the information provided by the Customer when ordering and to take all necessary measures to verify the identity of the holder of the payment method used.

ARTICLE 13 – Fight against bank card fraud

As part of fraud prevention and transaction security, CASSY reserves the right to suspend or cancel any order in the event of suspected fraudulent use of a payment method or inaccurate information.

In this regard, CASSY may request from the Customer any document enabling verification of their identity, the validity of the order and the link to the means of payment used, in particular an official identity document and/or a bank account statement.
The Customer must provide the requested supporting documents within a maximum of 48 hours. Otherwise, the order will be automatically cancelled.

CASSY also reserves the right to cancel any order whose control elements reveal a risk of fraud, at its sole discretion, without prior notification.
In the event of proven fraud, CASSY reserves the right to initiate any necessary legal or extrajudicial proceedings, in particular to obtain full compensation for the damage suffered.

ARTICLE 14 – Cookies

The website www.cassyshoes.com uses cookies to improve the user experience, personalize content and advertisements, and analyze traffic. These cookies also help us remember your preferences and provide social features.

All elements of the site www.cassyshoes.com , including texts, images, logos, graphics, videos, icons, and software, are the exclusive property of CASSY or its partners and are protected by intellectual property rights (copyright, trademarks, patents, etc.).

No reproduction, even partial, of the contents of the website www.cassyshoes.com is authorized without the prior written consent of CASSY. Any unauthorized use of elements protected by intellectual property rights exposes the user to legal action.

ARTICLE 16 – Gift Cards

CASSY gift cards are valid only on the website www.cassyshoes.com . They can only be used for online purchases and are not exchangeable for cash or refunds.

Terms of Use:

  • The gift card has no expiration date or expiry date.

  • The gift card can only be used once, for an order whose amount is equal to or greater than the value of the card.

  • If the order value exceeds the gift card value, the difference may be paid using another payment method.

  • The gift card can be partially used if the order amount is less than the value of the card.

  • In the event of loss or theft of the gift card, no replacement will be made.

Gift cards cannot be used to pay for delivery or other incidental charges.

ARTICLE 17 – Disclaimer

CASSY cannot be held responsible for any malfunction or technical breakdown of the website www.cassyshoes.com , nor for any access difficulties, network overload or temporary unavailability of services. The information and content provided on the site are for informational purposes only. Despite efforts to ensure their accuracy, errors may remain.

CASSY is also not responsible for the consequences of misuse of purchased products or misinterpretation of the information provided on the website. It is the Customer's responsibility to verify the specifications and information before any purchase.

ARTICLE 18 – Modification of the T&Cs

CASSY reserves the right to modify these General Terms and Conditions of Sale at any time. Any changes will be published on the website www.cassyshoes.com and will take effect as soon as they are posted online. It is the Customer's responsibility to regularly consult the General Terms and Conditions of Sale to be informed of any updates.
